Conditions of service: cancellation, return and refund Subject matter and scope of the contract

• The conditions of purchase apply to the products and services of DINKYS LIFE S.L. and hereinafter SEA U CHARTER and are aimed at a public over 18 years of age.
• The internet page www.seaucharter.com and/or www.dinkyslife.com is the website of the company DINKYS LIFE S.L., with CIF B09720525 and registered office at : Carrer Santa Margalida, 9, 07609 Llucmajor, Spain
• Please read these terms and conditions carefully to be informed of the rights and obligations of users in relation to the products and services offered by SEA U CHARTER. The validity of these terms and conditions will be recognised as binding by the user at the moment he/she decides to enjoy the service.
• The present terms and conditions apply when contracting and/or acquiring the services and/or products of our website and we reserve the right to modify the present terms and conditions at any time and without the need to inform the reason.

Reservation and Cancellation

• We offer users the possibility of reserving the boat they are interested in.
• The reservation will be effective upon payment of 100% of the reservation, being always cancellable and valid up to ten (10) calendar days before the day of service returning 70% of the total reservation.
• If after 1 hour from the start of the charter the client does not show up or there has been no prior notice, the booking will be considered cancelled and will be forfeited.
• It is still cancellable up to one (1) calendar day before the service and free of charge due to adverse weather conditions*. If this is the reason for cancellation, SEA U CHARTER assumes the cost and will refund any monies paid up to that time (including the booking fee). SEA U CHARTER reserves the right to cancel due to adverse weather conditions without the express wish of the client and/or agreement between both parties.
• During the Reservation Period indicated in the previous paragraph, the boat will be blocked and therefore will not be transmitted to any third party other than the user who formalises the Reservation.
• Reservations may be made in the following ways:
  • Through the booking module of the chosen boat on the website and/or other websites where it is offered.
  • Whatsapp
  • E-mail

Renting the boat

• The rental of the boat will be formalised through the signing by both parties of a rental contract for the boat chosen by the client, whose details will appear in the individual documentation provided by SEA U CHARTER.
• The rental price will depend on the amount indicated on the website and ultimately on the final commercial offer sent by SEA U CHARTER. This price may be subject to change depending on the model chosen and other expenses or formalities.
• The payment of the boat must be made at the same time as the formalisation of the rental contract, once the terms and conditions herein are accepted.
• The price, description or equipment of the boat, as well as its extras may be subject to possible variations. Please consult our advisors to confirm any information on the commercial and contractual conditions.
• Sailing on the island of Cabrera is strictly forbidden without specific permission.
• Anchoring in areas with posidonia is prohibited and sanctioned.
• Sub-chartering or re-chartering the vessel to third parties is prohibited.

Delivery of the boat (check-in)

• The boat will be handed over to the client at the time of the service, completely clean and sanitized, following at all times the strict sanitary guidelines in relation to the COVID-19 pandemic as well as all its extras.
• We will carry out the check-in and revision of the points delivered, as well as their subsequent verification at the check-out.
• The agreed deposit will be collected at check-in, using the payment methods accepted by SEA U CHARTER.
• A short briefing will be given to help the client, where we will review important points of navigation and the boat itself (in addition to weather and other needs of interest).
• The boat will be delivered with a full tank of fuel and the user will return the boat with the fuel used, being SEA U CHARTER in charge of replenishing the fuel and deducting it from the amount given as a deposit. It will always be on the following day or day (working day).
• SEA U CHARTER is closely committed to refunding amounts and terminating the contract after the end of the service as soon as possible.

Rights of use

• The data on the website may not be used by third parties for commercial purposes, for the creation of a database or for industrial use.
• Measures aimed at interrupting or hindering the operation of www.seaucharter.com and/or www.dinkyslife.com are prohibited.
• The extraction and collection of data from the website as well as the integration or linking to our service is prohibited without our express consent.
• The user grants SEA U CHARTER the unrestricted right to re-use online and offline the data sent to SEA U CHARTER free of charge.
• The presentation and operation of the products and services may vary depending on the type of access, e.g. via the internet or mobile applications.
• The data offered on the product and service pages may vary and are only binding for the conclusion of the contract.

Security

• SEA U CHARTER informs users that the web site uses information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all in order to prevent unauthorised access to data.
• The user agrees to the collection of data by means of the aforementioned techniques for the corresponding authentication of access controls.

Return (check-out)

• SEA U CHARTER will return the amount corresponding to the boat’s deposit after the service, after deducting, among other things, the fuel used and any damage caused, as well as the lack of any of its components and/or extras. Always in the same method of payment previously made.
• If the boat is rented with a skipper, the deposit will be lower as only the fuel used will be deducted.
• The user must return the boat in the same place where the check-in took place, on the day and time previously agreed.
• If the client is late at the agreed time of return, there will be a penalty of 100€ / hour.

Limitations of liability

• Due to the special conditions of multi-publication on e-commerce platforms (our products appear simultaneously on various websites and portals), it cannot be completely guaranteed that the service offered will be available until the reservation has been formalised with SEA U CHARTER.
• Access to www.seaucharter.com and/or www.dinkyslife.com may occasionally be interrupted or restricted due to maintenance work or the introduction of new services and functionalities. SEA U CHARTER will always and in any case try to minimise the time and frequency of interruptions.
• The exclusions and limits of liability of SEA U CHARTER shall also apply to its legal representatives, employees or agents.
• SEA U CHARTER uses third party databases to show the user the Equipment and Extras of the boats, therefore the details of the boats are subject to minor variations from the manufacturer and may not correspond or may be inaccurate.
• SEA U CHARTER will not pay for or replace equipment or extras not included due to faults or inaccuracies in the database.

Data protection

• The protection of personal data and the privacy of the users of our website is an important issue for SEA U CHARTER. For this reason, we ensure that we comply with the legal requirements of the applicable data protection regulations. For more information, please refer to SEA U CHARTER’s privacy policy.
• The personal information collected through our service will be that which is reasonable for the provision of the service. This includes, for example, the user’s e-mail address and, possibly, telephone number. The user will enter this information himself/herself via our online form.
• We use this information to the extent necessary to provide our services to the user. Electronic communications for the purpose of self-promotion of the service and not related to the notifications linked to the service expressly requested by the user will be sent, with the prior consent of the user by clicking on the corresponding box.
• It is possible to unsubscribe your e-mail address and telephone number at any time and without incurring additional charges to the basic rates. You can send us an e-mail to info@seaucharter.com.

Copyright and licence

• All trademarks, logos, text, images and other data on our website are subject to copyright. By using our site, the user does not have the right to further use this information. Modification, processing and use in media of any kind is strictly prohibited. Other use is only possible with the prior written consent of SEA U CHARTER.
• Unauthorised use of our information, as well as logos or trademarks of third parties appearing on our website, violates our rights or the rights of third parties and is therefore not permitted.

Severability clause If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall not be affected. This provision may be replaced by more valid and operative provisions that come as close as possible to the intended economic purpose. Applicable law, place of performance and jurisdiction The following contract is subject to Spanish common law. In all matters not provided for in this document and which are necessary by law, it shall be governed by the provisions of the legal regulations relating to guarantees contained in Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users.
